What about the German protection?! I think it should have priority over European law in the case of being more strict, shouldn't it?
No other German guy who can confirm the thing?

Not a German one, but I have to confirm this.
http://www.gesetze-im-internet.de/bartschv_2005/BJNR025810005.html#BJNR025810005BJNG000100000
But reading the text of the "BArtSchV", what about
§4(1)? nothing is written by picking them up with your hand ;)
§4(3)2. zum Schutz der heimischen Tier- und Pflanzenwelt - to protect native Flora and Fauna

Michael Glass wrote:Nono, there is another part. If specially protected, you are forbidden to pick them up, tentatively visit their habitats and disturb them, particularly, to photograph them. It's included in the text afaik!

Edit: It seems that the explicit mentioning of photography and filming has been substituted by a general statement about disturbance of any kind.

Is the there any qualifying statements in the text? In the UK equivalent legislation it refers to "wild" animals. If so, these could probably considered feral, so the protection wouldn't apply.

Michael Glass wrote:Well, as said in the other thread, German legalisation has all European reptiles and amphibians under protection - it does not at all mention whether they are alien or not. That's why it is illegal in Germany to release P. muralis in Hamburg (out of their natural range), but once sitting on the rock, they are protected and you are not allowed to collect them. ;)

I don't have an English version on my finger tips:
http://de.wikipedia.org/wiki/Anlage_1_z ... phibien.29
Amphibia spp. 3) 4) Amphibien – alle europäischen Arten -> (all European species)

Have I read (googletranslated) this right? These are protected in Germany?!!
